DownloadAll staff employed or working under a USDA-NRCS agreement will comply with Section 1619 of the Food, Conservation and Energy Act of 2008, (7 U.S.C. § 8791) (Sec. 1619) and the Privacy Act of 1974 (5 U.S.C. 552a - as amended).
Plain language explanation: These statutes state that while working under a government agreement information held by the government is protected from unauthorized use and unauthorized disclosure. Staff agree not to disclose protected information to anyone. Staff are personally liable for disclosure.
Unauthorized use/unauthorized disclosure of protected data is a violation of applicable Federal statutes. The staff will be held contractually, administratively, civilly, and/or criminally liable if there is a disclose of protected data. The provisions of Sec. 1619 are continuing obligations. Even when staff are no longer employed under a USDA-NRCS agreement (whether through expiration or termination of the agreement) or when individuals currently affiliated with the agreement holder leave the organization, every person having been provided access to protected data shall continue to be legally bound to comply with the provisions in Sec. 1619.
